SC refers senior cop’s case back to LHC

ISLAMABAD: The Supreme Court on Tuesday referred back to Lahore High Court (LHC) a matter pertaining to incumbent Islamabad DIG (Headquarter) Malik Jamil Zafar.

A two-member bench of the apex court comprising Justice Muhammad Hashim Khan Kakar and Justice Ishtiaq Ibrahim heard an appeal filed by former SP Faisalabad (current DIG Islamabad) Malik Jamil Zafar against an LHC decision.

The court directed the high court to decide the matter within two months after hearing the appellant’s stance.

During the hearing, counsel for the petitioner argued that when his client was SP Faisalabad, a trial court hearing a criminal case ordered his client to produce witnesses.

He informed the court that regarding the implementation of the court’s order, the trial court had made some negative observations against him in its ruling.

On this, Justice Ishtiaq Ibrahim remarked that it’s not just about putting people in jail; witnesses also need to be produced in courts, adding that the trial court judge himself could not go and bring the witnesses.

Justice Kakar asked the counsel as to whether the policeman standing with him was the DIG.

“Yes, my Lord”, he replied. Justice Kakar said, “Look, he is standing here and is scaring us too,” which led to a burst of laughter in the courtroom.

It is pertinent to mention here that when a Faisalabad trial court recorded observations against the SP, an appeal was filed against them in the LHC. But the judge dismissed the appeal by issuing a decision in his chamber, against which this appeal was filed in the Supreme Court.
