ISLAMABAD: The Supreme Court Tuesday received another Intra Court Appeal (ICA) against the decision of its constitutional bench which dismissed the petitions filed by five affected judges challenging the transfer of three judges from other high courts to the Islamabad High Court and formation of a new seniority list based on those transfers.

The joint ICA, filed by former president of the Supreme Court Bar Association Abid S. Zuberi, along with four other lawyers, prayed that the impugned judgment dated June 19, 2025 be set aside.

It was contended in the ICA that while interpreting the Constitution in its decision, the court ignored Article 175A.

They submitted that the principle of separation of the judiciary from the executive was overlooked adding that proper consultation with the respective chief justices was not conducted before the transfers, and that the notification regarding the transfer of the three judges to the Islamabad High Court was not in accordance with Article 200 of the Constitution.

The petitioners further contend that the matter of judges’ seniority cannot be referred to the president of Pakistan.
