Petition against plot to defame Jehangir, JS Group admitted

KARACHI: Judicial Magistrate South (Karachi), while admitting a petition filed against conspiring to defame Jehangir Siddiqui and other groups associated with the JS Group, ordered to record statements on January 04, 2014.
The petition was filed by Jehangir Siddiqui and Company Limited (JSCL) and JS Bank and made Aqeel Karim Dhedi, Chairman Diamond Group of Companies, Iftikhar Shafi, host and anchorperson of a television programme of a private news channel Mubashir, Khalil Masood and former chairman of Securities and Exchange Commission of Pakistan Muhammad Ali as party.
The petitioner said that the aforementioned defendants had hatched a conspiracy against Jehangir Siddiqui and different institutions and companies who formed JS Group in which the JS Bank and JSCL are included. Under this conspiracy the anchorperson had hosted a series of programmes on a private news channel and directly targeted Jehangir Siddiqui and other institutions and companies associated with him and carried out baseless propaganda against them. These programmes were frequently presented on a private TV channel.
According to details, it was said in the petition that the respondents had been rendering financial services more than others for last 40 years. The JS Group has high esteem in the eyes of people besides financial and trade world and JSCL, JS Bank and JS Group are enjoying great respect and repute. It said that the attack on the JS reputation and trust is generally considered attack on the reputation and trust of JSCL and JS Bank.
The accused No 1, Aqeel Karim Dhedi, considered himself so-called business rival of Jehangir Siddiqui and suffered from suspicion of ultimate success of the latter.The accused No 2, Iftikhar Shafi is a businessman who commonly makes investment in stock market. He had lost a very big deal of money due to wrong decision about the investment in the past.
The accused No 3, Mubashir is an anchorperson of a private news channel. He was publicly

exposed as an abettor in this conspiracy through his controversial programmes. He was involved in defamation through his programmes on the platform of the television for personal gain and carried out blackmailing and character assassination of others.
The accused No 5, Muhammad Ali is a former chairman of SECP who was removed by the Supreme Court from his post.It was said in the petition that baseless allegations levelled by aforementioned accused are clearly false and contemptible. It said that effort was made to inflict heavy damage to the reputation and trust of JSCL and JS Bank in the eyes of public at large, market and officers of the concerned regulatory authority by means of false and controversial programmes.
It was pleaded in the petition that steps of accused from No 1 to 5 come under the sections 499, 120-A and 34 of Pakistan Penal Code and on it a case could be filed in the sessions court and the accused could be sent to jail for five years under sections 500 and 120-B of Pakistan Penal Code.
