ISLAMABAD: The Supreme Court on Tuesday dismissed the government appeal filed against the restoration of service of an employee of Pakistan Post.
A two-member bench of the apex court, comprising Chief Justice Gulzar Ahmed, upheld the verdict of Service Tribunal, restoring service of Amna Rehman in Pakistan Post. The court, while rejecting the argument of the government, held that if the appointment of the petitioner was made in violation of the prescribed procedure, then people involved in the matter should be taken to task.
During the hearing, the counsel for the government contended that the said employee was removed from her service for being absent often from duties. The chief justice however, observed that she was removed from service as she was remained absent from duty only for one day.
The public prosecutor, however, contended that as the appointment of the respondent employee was not made in accordance with the prescribed procedure hence she was removed from the job. The chief justice then observed that if the employee was not appointed in accordance with the procedure, action should be taken against the responsible persons of the Department
Justice Ijazul Ahsen observed that the lady has been working in the department for eight years but now the department is bent upon sending her home.
Meanwhile, the court dismissed the government appeal, filed against the restoration of service of Amna Rehman in the Pakistan Post Department.
