SC rejects brother’s plea against sister’s share in inheritance

ISLAMABAD: The Supreme Court Monday dismissed a petition filed by a man against his sister’s share in inheritance.

A two-member bench, comprising Justice Hassan Azhar Rizvi and Justice Naeem Akhtar Afghan, heard the case titled ‘Shahabuddin vs. Maryam Bibi’. The counsel for the petitioner argued that his client had already given his sister her full share, but she claimed that she had received less than what was due.

Justice Rizvi noted that even the property distribution documents did not bear the signatures of the respondent, Maryam Bibi. Justice Naeem Akhtar Afghan remarked that bothers made their sisters serve them, but when it came to inheritance, they denied them their rightful share.

“Sisters cook meals for their brothers and clean their homes, yet they are deprived of their father’s inheritance,” he further remarked. Justice Rizvi observed that Holy Qur’an explicitly commanded that sisters must be given their share. “How can one deny a Quranic command?” the judge questioned. Meanwhile, the court dismissed the petition.
