Interim charge sheet names ex-Clifton SP, Darakhshan SHO among four cops as accused

The investigation officer has filed an interim charge sheet before a judicial magistrate in a case pertaining to the custodial death of a suspect at the Darakhshan police station.

On April 15, suspect Moiz Naseem, who was arrested in an extortion case, was found dead in the lock-up of the Darakhshan police station and an autopsy report revealed that he was beaten to death.

The IO charged absconding former Clifton SP Nayyar Ali, and detained Darakhshan SHO Ali Raza Leghari, Head Moharrir Faisal Leghari and Sub-Inspector Sanaullah Soomro.

The IO stated that on April 15, Moiz was arrested in an extortion case, adding that the SHO and the head clerk did not hand over the suspect to the investigation police. The police officers unlawfully detained the suspect, which led to his death, stated the charge sheet.

During the investigation, SHO Laghari disclosed that on April 14, SP Nayer-ul-Haq met him and said his friend Abdul Basit was being harassed by the suspect Moiz, the charge sheet said and added a case was filed against Moiz and Junaid based on the complaint of SP Nayyar-ul-Haq’s friend.

When the SHO went on a patrol, the head clerk informed him that SP Nayyar-ul-Haq had taken Moiz with him at 3:30am, the charge sheet mentioned.

In the light of the investigatio, and statements of the witnesses, the IO concluded that SHO Ali Raza, Faisal Leghari and Sanaullah were found involved in alleged commissioning of offences punishable under sections 109 (abetment), 201 (causing disappearance of evidence of offence, or giving false information to screen offender), 218 (public servant framing incorrect record or writing with intent to save person from punishment or property from forfeiture), and 342 (wrongful confinement) of the Pakistan Penal Code. He said SP Nayyar Ali should be tried for murder, abetment and wrongful confinement.
