ISLAMABAD: A division bench of Islamabad High Court (IHC) has suspended the judgment of a single bench given on Wednesday, April 27 directing registration of an FIR against three doctors of the federal capital including Dr. Major (R) Rizwan Uppal, Dr. Naushaba and Dr. Shamsa Rizwan. The division bench comprised Justice Noor-ul-Haq Ain Qureshi and Justice Athar Min Allah.
Earlier the single bench, headed by Justice Shaukat Aziz Siddiqui, had directed registration of an FIR against the three doctors on a petition submitted by Ms. Arooj Nisar, wife of Major Nisar, in which she alleged that she had lost her pregnancy due to negligence of the doctors.
The complainant had earlier approached Justice of Peace Islamabad on two occasions for registration of an FIR but her petition was dismissed first on November 16, 2015 and second time on January 9, 2016.
The Justice of Peace maintained that the cases of professional complaints were to be dealt with by the Pakistan Medical and Dental Council (PMDC) under the special laws and PMDC Ordinance.
The law prescribes a special procedure for dealing with such cases due to medical and technical intricacies involved for which the general machinery of the police isn’t equipped to deal with. The petitioner contented that the lady had already been diagnosed and labeled case of ruptured ectopic at a private hospital at I-10 before visiting the center belonging to the three doctors. She didn’t share the information at any stage.
