SHC dismisses plea against condition of vaccination card for domestic travel
The Sindh High Court on Friday dismissed a petition against the condition of having a vaccination card mandatory for domestic travel, terming it as not maintainable.
Petitioner Sohail Hameed had submitted in the petition that the government’s imposition of the condition of vaccination card for domestic travel without any Act was a violation of the constitution and amounted to excesses and transgression of the executive authority, which was liable to be stuck down.
He submitted that the Article 4 of the constitution provided protection of law to the citizens and safeguards their rights. The Article 4 recognised the supremacy of law against the executive action and stated that no person shall be compelled to do which the law did not require him to do, he added.
A division bench headed by Justice Mohammad Shafi Siddiqui questioned the maintainability of the petition and observed that a Covid-infected person could affect other persons of society and he was like a moving bomb.
The high court observed that the government action meant for the protection of citizens as Covid-affected persons could infect other persons. The SHC dismissed the petition as not maintainable and also imposed a cost of Rs25,000 over filing of a frivolous petition.
