PESHAWAR: A contempt of court petition was filed in the Peshawar High Court (PHC) for disqualification of Pakistan Tehreek-e-Insaf (PTI) minister and Member Provincial Assembly (MPA) for issuing direction to Education Department on official letterheads to appoint their men in violation of the Supreme Court’s decision and Constitution of Pakistan.
Ijaz Ahmad, a resident of Akbarpura in Nowshera district, had filed a contempt of court petition through his lawyer Barrister Mian Tajamal Shah. He had sought disqualification of Mian Jamshedud Din, PTI minister for excise and taxation, and MPA from PK-15 Idrees Khan Khattak as members of the KP Assembly.
The petitioner attached official letterheads of the respondent minister and MPA, through which they had asked the district education officer (male), Nowshera district for appointing their men mentioned in the letterheads in the department as Class-IV.
The petitioner submitted that the EDO, as per the list received in the letterheads, appointed all the seven persons, Muhammad Usman, Shakeel, Majid, Samiullah, Luqman, Aziz Ali and Islam Ali, recommended by the minister and MPA without considering merit.
The petitioner claimed in the petition that the above noted interference was also against clear directions of the Supreme Court. The petitioner requested the bench to make the minister and MPA as parties to his case and proceed against them under Article 204 of Constitution. He requested the court to declare them as disqualified from the KP Assembly for committing contempt of court.
