PESHAWAR: The nomination papers of Maulana Gul Naseeb Khan of Jamiat Ulema-i-Islam-Fazl (JUI-F) for general seat in Senate election was challenged in the Election Tribunal on Thursday.

Nasir Ahmad Khan, a resident of Chitral district, has challenged nomination papers of the Jamiat Ulema-i-Islam-Fazl provincial head through his lawyer Aminur Rehman Yousafzai.

The petitioner claimed that Maulana Gul Naseeb be declared disqualified for the Senate election as his candidature was filed by incompetent persons. Besides, he alleged that the Maulana was involved in corruption through his brother when he was a senator.

The election commissioner, Khyber Pakhtunkhwa and returning Officer have been made parties in the petition.

The petition said that nomination papers of respondent No.2 (Gul Naseeb) have been accepted by the returning officer for the general seat of Senate of Pakistan from Khyber Pakhtunkhwa as a candidate of JUI-F.

It was requested that his candidature was bound to be rejected as it was filed by incompetent and improper person on the strength of fake authority letter issued on February 7, 2018, although Maulana Gul Naseeb was abroad at the time.

“The election schedule was announced through a notification on February 2 and, on the same date, respondent No.2 was abroad, if at all, the nomination papers was supposed to be filed through authorized person, after issuance of notification on February 2 i.e. the election schedule, then the proper authority letter, duly attested from the consulate of Pakistan in the country of destination, should have been prepared for submission of nomination papers in question,” it was claimed in the petition.

It alleged that the candidate is involved in misappropriation of government funds in his previous tenure as Senator.

The petitioner claimed that Maulana Gul Naseeb utilised his development funds through his brother Zar Naseeb Khan with the connivance of Pak PWD Office at Batkhela through fake NITs and fake signatures on the tender forms.

He argued that this was evident from consolidated charge-sheet on September 26, 2017 of the Judge Accountability Court-IV, Peshawar, wherein his aforementioned real brother is nominated as an accused.

The petitioner maintained that the Jamiat Ulema-i-Islam-Fazl leaders was involved in corruption and corrupt practices and on this score his nomination papers ought to be rejected.
