The Supreme Court (SC) on Thursday halted the process of allotment of plots to the civil servants, who are on deputation in the Capital Development Authority (CDA).
A two-member bench of the apex court, comprising Justice Ejaz Afzal Khan and Justice Tariq Pervez, heard the case pertaining to plots allotted to the officers sent on deputation in the CDA.
Appearing on notice, Zulfiqar Khalid Maluka, counsel for ex-Employees Welfare Association, CDA, told the court that all the top management of the civic body were the officers on deputation. He submitted that the officers came to the federal civic agency on deputation for getting plots, adding the government officers who are on deputation in CDA even for six months, were also given plots of worth of million of rupees by the authority.
The learned counsel stated that the Supreme Court's 2013 judgement on deputation had clearly laid down criteria for the deputationists. He said according to the Civil Servant Act, the term deputation means transitory or temporary.
Counsel for CDA Muhammad Nazir Javaid, while appearing before the court, told it that any officer, who had 10-year service in the government department, would be entitled for the plot, adding any officer who joined the CDA on deputation one month ago would get the plot if he had served 10 years in his parent department.
Justice Ejaz Afzal, however, questioned if a civil judge joined the CDA on deputation and served it for one year, he was entitled to CDA plot. Counsel for CDA replied if he had served 10 years in the government department, he was entitled.
Khliad Maluka, however, informed the court that after the Islamabad High Court judgement, the CDA administration had prepared a plan for providing plots to the deputationists in federal civic agency. He further told that in 2005 about 200 officers were given plots by the CDA, but later the Ministry of Interior had stopped them.
Meanwhile, the court after hearing the parties halted the process of balloting of plots to the deputationists being held today (Friday) and deferred the case for two months.
