The passage of the 26th Amendment to the constitution signifies a transformation in the country’s judicial landscape. The amended Article 175 introduces a new selection process for the chief justice. A special parliamentary committee of 12 members will now select from among the top three most senior justices, moving away from the traditional seniority-based approach.

“The judiciary is the guardian of the constitution and the protector of individual rights” notes the landmark case of Al-Jehad Trust v Federation of Pakistan. The judiciary must remain impartial and resistant to external pressures. The public’s demand for swift justice without undue delays is enshrined in Article 10-A of the constitution, which guarantees the right to a fair trial. The current situation calls for unity among the top judges to ensure a strong and reliable court for the future. We hope Justice Afridi will set a positive precedent, upholding the principles of justice and fairness.
