NAB on the other hand through a press release said that it will challenge this order before Supreme Court (SC). IHC bench comprising Justice Aamer Farooq and Justice Mohsin Akhtar Kayani dismissed NAB's petition. An AC on October 2 had issued non-bailable arrest warrants for Capt Safdar and on October 9 granted bail to him after he was arrested by the NAB officials at Islamabad airport.

Before that, AC had issued non-bailable arrest warrants for Safdar after he did not appear before the court despite summons. In the petition, NAB had cited Safdar and AC as respondents. NAB in its application said that Safdar is an accused in Avenfield corruption reference.
