Sia and Dan Bernad’s messy custody battle has gotten to a new point after he appealed for the sole custody of their son.
The 49-year-old singer is the primary parent to their one-year-old son, Somersault “Summi,” while the estranged parents fight their legal battle, but Bernad recently made some serious allegations against Sia deeming her unfit for the custody.
Bernad accused Sia of being an unfit parent because of addiction issues, but according to the latest update, the judge has denied his request for sole custody.
The Los Angeles County judge declared insufficient evidence to be the reason for his denial, as per the court documents obtained by Page Six on Wednesday.
“The court finds that sufficient exigency for the requested emergency relief has not been shown at this time,” read the legal document.
Bernard, an oncologist, claimed, “Sia is an unfit and unreliable parent struggling with substance abuse and addiction,” whereas, he added, “I am a doctor, young, healthy and have no criminal history or drug or alcohol addiction issues.”
He also requested random and regular drug testing for his estranged wife, as well as supervised visits with Summi.
However, the Cheap Thrills hitmaker fired back, calling Bernad’s claims an “attempt to weaponise” her, adding that she has been sober for six months.
