Procedural law in Pakistan suffers from various defaults and shortcomings due to incompetence among lawmakers tasked with its creation and amendment. These deficiencies have significant implications for the legal system and the protection of individuals’ rights. Some key issues stemming from incompetent law-making in procedural law include poorly drafted procedural laws often contain ambiguous language or lack of clarity in outlining legal procedures and inefficient, convoluted procedural rules which contribute to delays in the resolution of legal disputes, and failure to adequately safeguard individual rights and protect against abuses of power within the legal process.
Addressing these defaults and shortcomings requires a concerted effort to reform procedural laws, prioritizing clarity, coherence, and fairness in their drafting and implementation. Lawmakers must demonstrate competence and diligence in the legislative process, consulting with legal experts and stakeholders to identify and rectify deficiencies. Moreover, robust monitoring and evaluation mechanisms are essential to ensure that procedural laws effectively serve the interests of justice and uphold rule of law in Pakistan.
