LAHORE: Lahore High Court Chief Justice Khawaja Muhammad Sharif on Thursday disposed of a habeas corpus petition against detention and possible extradition to the US of five US nationals arrested from Sargodha on charges of planning to fight against the US forces in Afghanistan.
The chief justice, however, directed the authorities concerned not to extradite the detenues without the court permission. The petitioner, Khalid Khawaja, the president of the Defence of Human Rights, and his counsel, Tariq Asad, did not appear in the court.
An additional advocate general informed the court that the case was not habeas corpus, since all the five accused were on physical remand and being interrogated by police. He said he could not provide any assurance to the court that the accused would not be extradited to the US. The chief justice directed the authorities not to hand over the accused to the US without the court’s permission.
