LAHORE: Chief Justice of Pakistan Justice Iftikhar Mohammad Chaudhry on Saturday reiterated that courts would intervene whenever there is a violation of the Constitution and fundamental rights. The prime responsibility of dispensing justice according to the National Judicial Policy and making it a success lies with district courts, which unfortunately have not come up to the heightened public expectations as yet due to a few black sheep. He said that these element should be pointed out so that the judiciary could be cleansed,
He was addressing a reception given in his honor by the Lahore Bar Association at Aiwan-e-Iqbal on Saturday.
The function was also addressed by Lahore High Court Chief Justice Khwaja Mohammad Shareef, lawyer leaders Aitzaz Ahsan, Hamid Khan, Supreme Court Bar Association president Qazi Anwar, Lahore High Court Bar president Nasira Javed Iqbal, Lahore Bar president Rana Zia Abdul Rehman and Muqtadar Akhtar Shabbir. Supreme Court Judges Justice Khalilur Rehman Ramday, Justice MA Shahid Siddiqi, and judges of Lahore High Court were also present.
Iftikhar said the historic movement of lawyers had set up a nursery of ‘Rule of Law and Constitutionalism’ and now it was the duty of everyone in the judiciary to protect and promote it for the better future of the nation.
He mentioned that complains were pouring in against district judiciary where 99 per cent majority comprised of honest people but earning bad name due to a handful of black sheep.
Reminding the subordinate judiciary of three times increase in their emoluments by Punjab government which raised the salary of sessions judges to almost 160,000 rupees, he said now they had no excuse for not living in their legitimate (Halal) earnings.
He said courts received countless complaints everyday large majority of which were against Police and Administration. He said that if Police and administration did there work honestly, the load of litigation on courts would be automatically reduce to less then half.
He cited the example of sugar crisis saying court did there job and now it was the responsibility of administration to do the rest. He said the process for appointment of judges on vacant seats in High courts and subordinate judiciary was under way with the consultation with LHC Chief Justice and other members of judiciary, and vacant seats would be filled at least in Punjab very soon.
An ugly scene was witnessed when LHC chief justice Khwaja Mohammad Shareef began his speech. An unknown lawyer who had some grudge against the chief judge jumped before the stage and began raising slogans against him. He was joined by a few of his colleagues also. However, he was immediately taken away by others and made him sit down.
Another incident was reported from outside the Aiwan-e-Iqbal where a man from Ucch Sharif, his wife and three children attempted self-immolation by pouring petrol upon them when they were denied access to the chief justice. The security personnel overpowered them before they could light a match.
Rajab Ali, his wife Nasreen and their children wanted to meet the chief justice of Pakistan to apprise him about continued denial of justice to them since their property was occupied by influential squatters supported by local police. They said even the orders of chief minister were not carried out by the police to get them justice.
Strict security measures were adopted for the reception as the road in front of the venue was closed for traffic while a bullet proof stage was prepared. However, after chief justice’s arrival, the bullet proof glasses were removed on his orders.
Lawyers kept disrupting the speeches with unruly sloganeering during the reception which looked more like election campaign since majority of lawyers were displaying badges and stickers of their candidates of the upcoming elections of Punjab Bar Council scheduled for November 21 and also kept distributing election badges, stickers and pamphlets.
