 Plea challenges verdict on operations, drone attacks

LAHORE

AN Intra-Court Appeal (ICA) was filed before the Lahore High Court on Friday, challenging the decision of a single bench which dismissed a petition against the military operation in Fata and permission for American drone attacks.

The petitioner, “Wukala Mahaz Barai Tahafaz Dastoor,” through their counsel Dr Abdul Basit, pleaded for setting aside the order of the single bench and issuing directions for the federal government to stop military operation in Fata and American drone attacks.

The counsel sought directions for the government to declare the USA as an enemy of Pakistan and stop helping it by protecting Nato supply lines through surface transit over the Pakistani territory. The petitioner prayed that the Pakistan army should be directed to defend the country with all means at their disposal, including its nuclear arsenal.

A singly bench, comprising Justice Asif Saeed Khosa, had dismissed the petition on October 9, observing that the petitioner’s pleas were either outside the scope of jurisdiction of the court or they pertained to matters of the government policy which the court had consistently refrained from entering into.

In the ICA, Dr A Basit requested that a judicial notice be taken against American and Nato forces for aggression against Pakistan on almost a daily basis.

He said that Pakistan army spokesman claimed to have the capability to shoot down drones but the government had taken a policy decision to permit the killing of Pakistani citizens.
