PESHAWAR: Newly elevated chief justice of the Peshawar High Court (PHC), Justice Ejaz Afzal Khan, is the only judge from NWFP, both in Supreme Court and PHC, who was restored on March 16 along with Chief Justice of Pakistan Iftikhar Muhammad Chaudhry.
According to the State-run television, President Asif Zardari elevated PHC Chief Justice Tariq Pervez Khan to the Supreme Court while Justice Ejaz Afzal was notified as chief justice of the PHC.
However, there was no mention of Justice Shah Jehan who was the senior most judge of the PHC after Chief Justice Tariq Pervez.
Justice Ejaz Afzal along with three other judges of the PHC — Chief Justice Tariq Pervez Khan, Justice Shah Jehan Yusufzai and Justice Dost Muhammad Khan — had rejected the offer to take oath under the Provisional Constitution Order (PCO).
His three brother judges, however, agreed to rejoin office on September 5, 2008 by taking fresh oath under the Naek formula.
Born to a middle class family of Mansehra on May 8, 1953, Justice Ejaz got his primary education from Government Primary School Mansehra, did matriculation from Government High School Mansehra and FA from the Government College Mansehra.
Then he joined the Government College Abbottabad and did graduation in 1974. Subsequently, he graduated from the Khyber Law College in 1977 and joined the profession of law the same year.
In 1979 he got the licence to practice in the Peshawar High Court and in 1991 he was awarded the licence to appear before the Supreme Court as a lawyer. He was elevated to the PHC in 2001.
As a lawyer he would deal in all type of cases but he earned fame in cases relating to constitutional matters.
