| SHC moved to locate missing PML-Q activist |

The Sindh High Court (SHC) was moved to ascertain the whereabouts of a missing activist of Pakistan Muslim League-Q (PML-Q), who was allegedly arrested by law enforcement agencies (LEAs) on July 11.
Petitioner Ms Afshan submitted that her husband Mohammad Farooq alias Leghari, 32, was arrested by LEA personnel in a raid at her house in Landhi. She said that a police party raided her house in the wee hours of the morning, and inquired about Bashir, whom they said they were searching for. She said that when they were told that there was no person named Bashir living there, 15 police personnel entered the house and misbehaved with the family, and took away Farooq.
Ms Afshan told newsmen that a written complaint had also been sent to the Quaidabad police station, but no action had been taken thus far, while other LEAs denied the detention or arrest of Farooq.
She prayed to the court to direct the government to ascertain the whereabouts of her husband and order his release if he was not involved in criminal cases.
Meanwhile, the father of Farooq’s friend Sohail, Abdul Sattar, said that his son was also missing since July 11 from Arambagah. He said that he did not want to accuse anyone, but wanted the government to ascertain his son’s whereabouts.
TALUKA NAZIM PLEA: The SHC directed the provincial law officer to file objections to a petition filed by a sacked Taluka Nazim of Dadu.
Petitioner Nabi Bux challenged his removal by the local government secretary, and prayed to the court to set aside the impugned notification.
Additional Advocate General Abdul Fateh Malik sought time to file objection on the petition.
The court said that since the matter pertained to the removal of the Taluka Nazim and the entire working of the area had been jeopardized, the AAG was to file objections prior to the next date of hearing, when the matter would be heard and decided. The court also continued the interim stay till the next date of hearing.
APPEAL DISMISSED: The SHC dismissed an appeal against acquittal of a man in a kidnapping-for-ransom case.
Amjad was acquitted by the anti-terrorism court (ATC) from charges pertaining to the kidnapping of six-year-old Saifullah for ransom. According to the prosecution, the respondent took the boy to the tribal areas and received ransom for his release.
Baroman Khan submitted that the trial court erred in acquitting the respondent from kidnapping for ransom charges. He prayed to the court to order re-trial of the respondent. The court after hearing the appeal upheld the trial court’s order and dismissed the appeal.
MISSIONARY TRUST PETITION: The SHC issued a notice to City District Government Karachi (CDGK) Education District Officer (DO) and others on a petition against unauthorised construction in Saddar Town.
Churches Missionary Trust Association submitted that the trust was running the Church Missionary Vernacular School in Bolton Market, which was renamed Sheldon Boys Primary and Secondary School after nationalisation. The petitioner’s counsel said that the trust wanted to reconstruct the building of the school, but some private persons had initiated unauthorised construction on the premises.
The petitioner prayed to the court to direct the Education Department to secure the school land, and order the demolition of the unauthorised structure.
Admitting the plea, the court issued a notice to Education DO, Revenue Group of Offices (Enforcement) DO and 13 shopkeepers and called for their comments.
FINE IMPOSED: The SHC imposed a Rs5,000 fine as cost on Sindh Local Government Department secretary for delaying the disposal of the case.
The court was hearing the petition of Abdul Sattar and other labourers, who were appointed on contract for roads maintenance work in district Thatta, and sought extension in jobs as approved by Zila Council Thatta.
Provincial law officer sought time to file comments on behalf of the respondent. The court however observed that after the announcement of the Judicial Policy, concerted efforts were being made to curb delay. The court observed that despite order, the LG Department secretary had failed to file comments.
Adjourning the matter till July 21, the court ordered that cost of Rs5,000 be imposed on the adjournment and the amount be deposited in the Sindh High Court Bar Library Fund.
