AGP’s clarification memo to CEC

ISLAMABAD: Attorney General of Pakistan (AGP) Tuesday sent a memo clarifying the disqualification of the dual nationality holder parliament members stressing on taking actions against them in accordance with the constitution instead of the court order, Geo News reported.

 

AGP Irfan Quadir in a letter written to the Chief Election Commissioner (CEC) said that under Article 5 of the constitution the Election Commission has to make a decision itself on the issue of dual nationality and added that none of the court including the Supreme Court could give directives to the Election Commission.

 

The memo further said that the disqualification of the dual nationality holder parliament members have been done under Article 631(c) and CEC while taking action should keep in view the constitution and his oath to it.

If the judgement of the Supreme Court is not binding on CEC, perhaps the court should be called Supreme(Excluding CEC) Court. One did not expect this from the Attorney General.

Ever heard of a puppet on a string? This is what the Attorney General is. He has disgraced his high office by cheap theatricals and totally intolerable antics. Hats off to the honorable judges of the Supreme Court for their patience, tolerance and forbearance in dealing with this lout. I totally agree that Mr. Fakhruddin Ibrahim must have forgotten more about law and constitution, than Irfan Qadir ever learnt.

The objectives of this guy is to obstruct all the legal proceedings from SC, try to make the decisions controversial, create as much confusion as possbile, and demonstrate unethical behaviour any where possible. DOES the AGP has any right to advise the CEC on what he is supposed to do and what he shouldn’t do. The duty of the Attorney-General is to give advice to the Federal Government upon such legal matters, and to perform such other duties of a legal character as may be referred or assigned to him by the Federal Government, and in the performance of his duties he shall have the right of audience in all courts and tribunals in Pakistan. ECP is outside his domain.

Mr Qadir would be well advised to remember his own oath to the constitution and start behaving as a servant of the people rather than acting as a servant of Mr Zardari. Mr Fakhruddin G Ebrahim has forgotten more about the law and constitution than Irfan Qadir ever learnt.

Now is this legal?Can the AG instruct the CEC headed by a retired ,very respected judge of the SC himself with other judges also in the panel making a decision.
