SC to hear review petition on August 15

ISLAMABAD: Supreme Court on Saturday set August 15 for hearing government's review petition in NRO implementation case, Geo News reported.

 

A five-member bench headed by Justice Asif Khosa will hear the petition.

 

The government had filed a review petition against the July 12 order of the Supreme Court in the NRO implementation. The petition was filed by Attorney General Irfan Qadir.

 

According to the review petition, the prime minister had not received any advice to write the letter, adding that he was not bound to write the letter.

 

The petition further claims that the Supreme Courts June 27 and July 12 orders in the case are unlawful and if the letter it written it will violate Article 248 of the constitution.

 

Another argument made in the review petition states that the court itself cannot write the letter to Swiss authorities then why was it expecting the prime minister to do so.

Court should dismiss petition as grounds previously argued that writing to Swiss without advice will breach Article 248 of immunity of President. Under International protocol head of state cannot be arrested but he may not be able to prevaricate of an appearance before own Court as with Nixon or Clinton, Swiss money was baggage brought before his term in office. Further writing to Swiss will not trigger immediate arrest, but serves as a notice on Swiss of claim of Government on stolen booty.
