CII declares three consecutive declarations of divorce punishable

ISLAMABAD: The Council of Islamic Ideology (CII) decreed on Wednesday that a husband who says divorce three times consecutively is liable to punishment as it should be considered un-Islamic.

ISLAMABAD: The Council of Islamic Ideology (CII) decreed on Wednesday that a husband who says divorce three times consecutively is liable to punishment as it should be considered un-Islamic.

Addressing a press conference, CII Chairman Maulana Muhammad Khan Sherani said that a man could pronounce one divorce at a time as per the method prescribed by the Shariah.

According to the Islamic family law, a man has to divorce the spouse three times before the divorce legally comes into effect.

The council also suggested that the person responsible to approve on paper three divorces consecutively should also be liable to punishment.

According to the Council, to remarry after a first divorce, a reference would be needed and to remarry after a second divorce a Nikah would be necessary.

Meanwhile, any woman over 40 years of age can be appointed as a judge given that she follows Islamic hijab, said Shirani.

Mufti Naeem backs CII recommendation

Backing the CII recommendation, chief cleric Jamia Binoria Mufti Mohammad Naeem said that three consecutive divorce declarations are against the Sunnah.

“In our society, divorces are given on petty issues,” he said, adding that divorce rates are increasing in the country.
