LAKKI MARWAT: The officials of the Education Department in Lakki Marwat violated the court orders by not placing a petitioner on a driver’s post.
Talking to The News here, Shahid Gul, son of Abdur Rahim, belonging to Haqdadabad in Lakki Marwat district, said that he had also applied for the post of driver advertised by the district education authorities on May 11, 2010.
He said that he appeared in the driving test and interview was conducted in Bannu where he stood first in both the test and interview. “I have a valid light transport vehicle (LTV) licence and done my matriculation,” he said.
He said that former District Education Officer (DEO) Noor Hassan Khan, illegally and unlawfully, in violation of merit appointed his nephew, Sohail, against the post of driver despite the fact that he had not possessed a driving licence, no matriculation certificate, and even did not appear in the test or interview.
He said he moved court which stated in its judgment that he was fully qualified, competent and entitled to be appointed as driver. Therefore, depriving him of appointment on the said post mounted to deprive him of his fundamental rights guaranteed under the constitution, the court pleaded.
He said the court concluded that the appointment of Sohail, nephew of the ex-EDO, Noor Hassan Khan, may please be declared as illegal, without lawful authority, without jurisdiction, against the merit and recruitment policy and inefficiency upon the rights of the petitioner.
He said the court also directed the officials concerned in Lakki Marwat to appoint the petitioner against the driver post arising out of the termination of Sohail or at any vacant post or any other appropriate relief which this honourable court deems fit in the circumstances of case may be granted to the petitioner.
He said the officials did not comply with the court orders and appointed another person after the termination of Sohail.When contacted, DEO (F) Razia Khattak said that she had a discretionary power to appoint a driver.
Regarding the court verdict, she said, “We have not violated the court orders but at the moment there is no vacancy to adjust Shahid Gul as the post fallen vacant after termination of Sohail has already been filled out by hiring another driver, Samiullah.”
