The Sindh High Court (SHC) on Friday directed the family of Moazzam Ali Khan, an alleged facilitator in Muttahida Qaumi Movement leader Dr Imran Farooq’s murder, to approach the Federal Investigation Agency (FIA) for a meeting with the detainee who was now being held by the agency for interrogation in Islamabad.
The direction came on a petition by Moazzam’s spouse, Sadia Bano, against shifting the custody of her spouse to FIA. She submitted in her that petition her spouse was arrested on April 12 by the Rangers and placed him in preventive detention under section 11-EEEE of the Anti Terrorism Act 1997.
She stated that the custody of the detainee was illegally handed over to the FIA for interrogation in Dr Imran Farooq murder case after completion of 90-day detention, despite the fact that a joint investigation team, in which an FIA member was also included, had already completed the investigation. She argued that shifting the custody of her spouse to FIA from Rangers for investigation in connection with the murder offence was unlawful and requested the court to declare handing over Moazzam’s custody to the FIA as illegal. She also sought permission from the court to arrange a meeting with the detainee as per jail rules
