ISLAMABAD: The Supreme Court has taken notice of a unique application in which eleven serving officers of Pakistan Public Works Department (Pak-PWD)have leveled corruption charges against Federal Minister for Housing and Works Faisal Saleh Hayat and sought protection against his illegal orders.

 

The application has been entertained by the Human Rights Cell of the SC and has been numbered as HRC 13397-G/2012 and Ministry of Housing and Works has been asked to file a reply.

 

The PWD officers have also written to the Chief Justice that they were ready to file affidavits against the minister in case the court provides protection to them against the allegedly illegal orders of the minister. The Federal Minister for Housing is out of the country and was unreachable. Even a message sent to him remained unanswered.

 

The officers include Ata Ul Haq Akhtar Chief Engineer, Mian Masood Akhtar Superintending Engineer (SE), Fidayat Shah SE, S M Zohair Khalid SE, Ch Muhammad Nawaz SE, Mohammad Khalid SE, Muhammad Rashid Executive Engineer, Subhash Chander XEN, Fayaz Muhammad XEN, Rana Saleem Akhtar XEN and Irshad ul Hassan Assistant XEN.

 

The application, supported by 150 supporting documents, says that Faisal Saleh Hayat trumpets the slogan of “Zero tolerance for Corruption” but does he really mean this or may be uses this for exploitation. “We agree that Ministry of housing and Works and its subordinate departments including Pak PWD never enjoyed good reputation. Nevertheless, these departments do have officers who work honestly and judiciously as true custodians of national exchequer, but now-a-days, the lives of all such officers have been made miserable by the federal minister,” the application says.

 

‘Federal Minister is putting all types of pressures on PWD officers to indulge in rampant corruption in public funds and sweeping money through his trustworthy front men including his relatives and government officials. These include Haider Kharal (cousin), Nayyar Haider (brother-in-law), Hassan Shah with fake name of Javed Ch (cousin), Noshair Chaddar, Sh Rizwan, Sherwani, MB Awan (Sr JS), Malik Iqbal (Director) and few Pak PWD officers holding key posts. Minister having experience of his trail in NAB, does not pass order in his writing/tangible way which can be used as evidence against him but mostly relies on verbal orders passed through these front men. At the very outset, the minister brought his trusted men on all vital posts of Ministry. Mr M B Awan Senior joint Secretary enjoys very dubious reputation and acting as focal person for all illegal activities of the minister.’

 

‘The Minister for Housing and Works has earmarked all posts through which the development funds are spent. Federal minister through his front men demands 12% share on all allocations as bribe at the time of tendering and gets additional 2% on monthly payments. That out of four regular chief engineers, three posts have been kept vacant and current charge to junior most officers who are meeting their unlawful demands. There are 14 posts of field superintending engineers (SEs), out of which 8 posts are lying vacant and assigned to junior most executive engineers (XENs), while regular SEs are either waiting for posting or unlawfully suspended on their refusal to be part of corruption. It would be astonishing to note that Mr Gulab Zameer, Chief Engineer has been assigned one post of Director General and two posts of Chief Engineers simultaneously whereas Mr Wazirzada, Superintending Engineer has been entrusted one post of Chief Engineer and two posts of SEs at different stations. Most amazingly, Mr Mohammad Sarwar Awan, Chief Engineer Karachi was assigned four junior posts of Superintending Engineers at a time. Mr Maqsood ahmad, SE has been given the charge of one Chief Engineer and four Superintending Engineers at one time. Mrs Humera Khurram, a junior most XEN (on probation) has been given charge of one Superintending Engineer and four XENs of various stations simultaneously. All such postings are neither permissible under the rules nor humanly possible for supervision of works according to Pak-PWD code (revised) 1992.’ ‘The officers are being threatened including dismissal from service by the front men of minister.
