LIAQUATPUR: A local court fixed 25th May, 2013 as the date of hearing of the civil case filed by M/S Diwan Sugar Mills against Ms Hina Yusuf praying the court to cancel her ownership documents of agricultural land for not making payment of Rs80 million as price of the land.


The court passed orders for the respondent Hina Yusuf wife of Diwan Mohammad Yusuf Farooqui to appear in the court in person on the said date.


Earlier on July 16, 2012 M/S Diwan Sugar Mills Ltd filed a civil suit in a local court through their counsel Syed Haider Abbas Zaidi for cancellation of ownership documents against Ms Hina Yusuf, on the plea that Diwan Mohammad Yusuf Farooqui is the chief executive of Diwan Sugar Mills Ltd, KLP Road, Janpur Tehsil Liaquatpur, district Rahimyar Khan and has the right to dispose of the land.


On May 2, 2011, Diwan Mohammad Yusuf Farooqui, the chief executive of Diwan Sugar Mills Ltd sold for a sum of Rs80 million different pieces of land at Chak No 130 NP Moza Piraran Sharif, KLP Road, Janpur Tehsil Liaquatpur, district Rahimyar Khan to Hina Yusuf wife of Diwan Mohammad Yusuf Farooqui as detailed below: 8,231 kanal (from Khatauni No 229 out of Khata No 184/184); 862 kanal & 7 marlas (from Khatauni No 275 out of Khata No 222/222); 79 kanals & 14 marlas (from Khatauni No 277 out of Khata No 223/224); and 115 kanal & 3 marlas (from Khatauni No 279 out of Khata No 225/226).


However the defendant Hina Yusuf did not make payment of the agreed price of the land whereas the documents have been prepared in her name. Hina Yusuf has so far not yet been able to make payment.


Therefore the learned court is requested to cancel the transfer documents of the land and pass orders to all the officials responsible for preparation of these documents to cancel all the documents concerning the land.


During the hearing of the case the defendant Hina Yusuf, through her counsel Syed Mohammad Haider Zaidi submitted her detailed reply, her recorded statement in which she submitted that she has no objection to the case filed by the petitioner of cancellation of ownership rights of the land, or to a decree against the defendant.


The court ordered the defendant to appear in person on which the defendant filed an application through her counsel that she is not in a position to travel all the way from Karachi to Liaquatpur, therefore the statement of Hina Yusuf be recorded through a commission in Karachi.


Rejecting the plea on 15th November 2012, the court observed in the order that Hina Yusuf has not given any plausible reason for her inability to travel.


Therefore the court ordered the defendant Hina Yusuf to appear before the court in person and fixed 25th May, 2013 as next date of hearing.
