ISLAMABAD: Dr Arsalan Iftikhar Friday filed a review petition in the apex court’s June 14 judgment in a case regarding alleged business deal between him and real estate tycoon Malik Riaz.

 

A two member bench of the apex court, comprising Justice Jawad S Khawaja and Justice Khilji Arif Hussain, on June 14, 2012, while hearing a suo moto case regarding graft case, involving Malik Riaz and Dr Arsalan Iftikhar, had expected that Attorney General Irfan Qadir will set the machinery of the State in motion so that all those who may have committed any illegal acts, including Malik Riaz, Dr. Arsalan and Salman Ali Khan are pursued and brought to book with the full force and rigour of the law.

 

In his review petition, filed through his counsel Sardar Muhammad Ishaq Khan, Dr Arsalan, however, contended that the court’s orders are not being followed properly as the court did not order the attorney general to forward the case to the National Accountability Bureau (NAB). He submitted it shows that the attorney general has interpreted the court’s decision in a wrong way. He contended that the heads of various components of the present investigative state machinery are all having tainted past and their own axe to grind against the superior judiciary.

 

He said that the NAB chairman, besides having his appointment as such, challenged before this august court, is a person of suspect past, having proven links with Malik Riaz, so much so that till recently even his daughter, namely, Fahmina Bukhari was working for Mlaik Riaz for the last quite few years.

 

Similarly, he stated that the Federal Investigation Agency is directly functioning under the supervision and control of Rehman Malik, whose membership of the Senate has recently been suspended by a learned bench of this court.

 

He submitted that the Islamabad police is also completely under the influence of the Interior Ministry, hence under Rehman Malik, and considering the past record of the said agency with regard to investigation of different high profile cases and in view of different observations, passed by the apex court in a number of cases, the inquiry process, under these circumstances, can be termed any thing but transparent or impartial.

 

He also alleged that the joint investigation committee, formed to probe the graft case, is illegal and biased as its members have close links with Malik Riaz. Dr Arsalan also revealed that the head of the team Kausar Iqbal owns a house in Bahria Town’s Executive Lodges while SP Faisal Memon’s links with Riaz are not hidden from any one.

 

He requested the court that the judgment of June 14, 2012, permitting the investigation of the allegations, made by Malik riaz Hussain, to be conducted by the state machinery be reviewed. He also requested to make the Federation, Malik Riaz, Ali Ahmed Riaz and Bahria Town party to the case. Another miscellaneous petition has also been filed, requesting the court to make the NAB chairman and Salman Ahmed party to the case.
