ISLAMABAD: A division bench of the Islamabad High Court (IHC) here on Tuesday dismissed a writ petition challenging the act of presidential pardon to a terrorism convict, a gunman of business tycoon Malik Riaz Hussain, Muhammad Basharat, who had murdered a person naming Hamid on January 9, 2010.
The bench comprising Justice Riaz Ahmad Khan and Justice Muhammad Azim Khan Afridi observed the presidential pardon could not be challenged before a court of law.The petitioners, Chaudhry Muhammad Naeem Ali and Umar Khayam, through their counsels Chaudhry Ashraf Gujjar and Barrister Zafarullah had challenged the pardon.
The bench also issued notices to the Adiala Jail superintendent seeking his reply on the petition of Basharat’s wife who said the jail authorities did not release her husband despite the fact that the president had pardoned him. The court will take up the matter on July 5.
