KARACHI: England and Wales Cricket Board on Wednesday filed execution application before the Sindh High Court for recovery of 249,279.50 UK pounds against former Pakistan Test cricketer Danish Kaneria in fine that was imposed by the Appeal Panel of ECB, which found the leg spinner guilty of spot-fixing in a limited-overs match in 2009.
Filing the execution application on behalf of the ECB, applicant counsels Khawaja Naveed Ahmed and Irfan Bashir submitted that ECB Appeal Panel passed judgment against Kaneria on July 18, 2013, for his involvement in spot-fixing which was upheld by the England and Wales High Court (commercial court) on July 25, 2013.
They submitted that debtor Danish Kaneria filed appeals against the ECB Appeal Panel arbitration award with the Commercial Court of England and Wales and then the Court of Appeal of England and Wales, both of which were dismissed entirely by way of court orders on May 6, 2014 and July 28, 2014, respectively.
They said that Danish Kaneria had not filed any appeal in respect of the Commercial Court arbitration order issued against him on July 25, 2013.
They said Kanaria had made a total payment to date of £24,985 in respect of the £49,270.50 Commercial Court order.
They said that total recoverable amount was £224,285.50 plus interest.
They prayed that the court appoint Nazir of the court to attach the six bank accounts and immovable property of the debtor situated in Clifton area for recovery of the amount. Kanaria took 261 wickets in 61 Tests and 1024 wickets in 206 first class matches.
